Amicus Andrew XXXXXX (“XXXXXX”) is a shareholder with a serious and devoted
financial interest in the outcome of this litigation. As such, XXXXXX has been deeply
involved in the progression of the abovementioned lawsuit (“Northpoint”) and hopes
to bring to the Court's attention information not clearly presented by any other brief
heretofore submitted. XXXXXX believes the information offered in the Memorandum
supports a court decision that would reject the settlement offer made by Verizon
and accepted by NorthPoint’s bankruptcy Trustee, E. Lynn Schoenmann.
